Counter sue. Tell them that they effectively annulled their "marriage" when they made their permanent residence in Poland. They knew their social situation was not possible there yet they tried it anyways. It must mean that they no longer cared to maintain the illusion of their marriage and it should be, by default, ruled no longer in effect.
If they wanted to stay in fantasy land they should have stayed in Germany. Their own actions dictate the seriousness with which they held their own vows. Which was apparently none. So we've now fixed that and divorced you as a matter of course.

Forget "effectively". Just draft a law, so that Poland actually divorces any same sex couples that enter their country.
