Counter sue. Tell them that they effectively annulled their "marriage" when they made their permanent residence in Poland. They knew their social situation was not possible there yet they tried it anyways. Forget "effectively". Just draft a law, so that Poland actually divorces any same sex couples that enter their country.

So Poland can perform a divorce when Germany doesn't approve, for example on setting foot on polish soil.
