I don't know that it's a good idea to involve the state with marriage at all. It's supposed to be a committment under God, not government.
Either parent can take the kids but they have absolutely no legal recourse to *any* support. Whoever makes the money, keeps the money but whatever they already spent is gone. Property ownership falls to whomever's name is on the ownership documents.
Then the churches can decide if they will allow divorce/remarriage/gays etc.
