> basically zero downsides
false. history has shown time and time again that extreme authoritarianism virtually always devolves from small scale executions to genocide.
now don't get me wrong, i think we should be prosecuting crime FAR more than we currently do (especially in deep blue shitholes), and even that our threshold for the death penalty is too high.
but giving government nearly unchecked power to execute people by declaring them violent is wildly anti-american. and as most people have seen, they will absolutely bend over backwards to defame political opponents as criminals.

The downside is that governments are retarded. If there were a way to guarantee that muderers, rapists, and mud sharks all got the rope, without either false positives *or* shifting the goal posts to enable executions for "hate" crimes, I'd be all for it.
That said, less than 1% of the population ever sees the defendant side of a court room. If those people were just gone...

sure, if you could guarantee it would never be able to be abused, and 100% of people subject to it were overwhelmingly guilty by a standard even higher than "reasonable doubt"... then sure. and at that rate, i'd say fuck appeals, just hold the execution immediately after conviction.
but we can't guarantee that. look at all the bullshit political persecutions of orange man.
