Not that it matters. Elon is a PayPal cofounder with Peter Thiel. Peter Thiel is a co-founder of OpenAI. They're close buddies. They probably laughed about it already. They're both developing these tools to give themselves power, create a global police state and control society. It's a big fucking joke! Elon really doesn't have any legal recourse. What's he going to say to OpenAI, "Show me your code base to prove you didn't steal our code?"
OpenAI will claim trade secret and accuse Elon of making up the whole thing to steal OpenAI's proprietary code via an audit. OpenAI could/ will also move their servers to a jurisdiction that offers them more protection or lack the legal infrastructure to do anything.
