Aside from him - how is this even reasonable or legal? It's akin to stuffing one's mouth in court, and then ask him "if you have something to say to your defense, say it." It's like breaking someone's legs as he lies on the ground and tell him "you are free to go, but if you stay I will punish you." You can't speak, you can't get away.
