They are, that's why there's so many "hate crime" convictions.

Much of this "vandalism" even includes someone going there and painting it in it's original color at night.

Most of these benches are in the bigger cities which never sleeps. No matter what time of day it is people will walk by, all it takes is one rat spotting you. Of course you can be more discrete too, but many people want to make a statement when painting over it.

Isn't it the same when you make doughnuts on a faggot crosswalk in the street with your car? Lots of people will see you do it, and your car has your loicense plates on it so it's not exactly anonymous either.

Even if it's taken to court (happens if you refuse to pay the fines which are extortion anyway and admission of guilt). Just deny every accusation and place the burden of evidence on them.
