For that the phone has to be activated, right? If it is shut down, has its battery removed or ran out, it shouldn't be possible. My phone as it is acts completely dead when any of that happens, and I get these "you are in a foreign country" SMS if it was off for more than a few days. I assume the triangulation, or generally checking via cell towers requires it to send signals.
I assume smart phones reserve some battery power when they are shut down, and they may still be connected to cell towers or send signals even when they appear off. Maybe this applies to all phones, including mine... I don't know.
