I understand what you're saying, and normally I would agree with you... But I also believe there should sometimes be exceptions to rules, and perhaps he is one of them.

The problem with that is, every time we've made exceptions, it came back to screw us over. See: Hitler's rare mistake of being too nice to the jews, for example.
